 All coaxial cable sold under the Extremeflex®
and Cell Reach® trademark and manufactured by CommScope are warranted to
be free from defects in material and workmanship for a period of ten (10) years commencing on the date of manufacture.
THE SOLE AND EXCLUSIVE OBLIGATIONS AND LIABILITIES OF COMMSCOPE UNDER THESE WARRANTIES IS AND
SHALL BE LIMITED TO ISSUANCE OF CREDIT FOR REPAIR OR REPLACEMENT OF ANY COAXIAL CABLE WHICH ARE
PROVED TO BE OTHER THAN AS WARRANTED,AND COMMSCOPE SHALL HAVE SOLE DISCRETION AS TO WHICH OF THESE REMEDIES IT SHALL PROVIDE. BUYER SHALL NOT BE REIMBURSED OR RECEIVE ANY ALLOWANCE FOR ANY LABOR CHARGES INCURRED FOR REPLACEMENT, ADJUSTMENT OR REPAIR OF ANY CABLE OR FOR ANY OTHER WORK UNLESS SUCH CHARGES ARE AUTHORIZED IN ADVANCE BY COMMSCOPE.
If any of the Cell Reach coaxial cable on which these warranties have not expired are claimed to be defective in material or workmanship,
CommScope may either examine the coaxial cable where they are located or, in its sole discretion, issue shipping instructions for return of the
coaxial cable or any defective parts thereof. Buyer shall prepay all transportation charges for such return. Any claim for breach of these warranties
shall conclusively be deemed to be waived unless written notice of such claim is given to CommScope within ten (10) days after the
date on which the claimed defect is discovered. These warranties shall be null and void if the original installing buyer transfers ownership of
the warranted coaxial cable, unless CommScope is notified in writing of the transfer and of the name and address of the new owner within
fifteen (15) days after the date on which the transfer is made. These warranties shall not apply to any coaxial cable which has been subjected
to any misuse, neglect or accidental damage or which contain defects which are in any way attributable to improper installation or to
alterations or repairs made or performed by a person or entity not under the control of CommScope. Further, these warranties shall not apply
to any coaxial cable which is obtained from manufacturers other than CommScope.
THE WARRANTIES SET FORTH HEREIN ARE COMMSCOPE'S SOLE AND EXCLUSIVE WARRANTIES FOR OR RELATING TO THE COAXIALCABLE. COMMSCOPE NEITHER MAKES NOR ASSUMES ANY WARRANTY OF MERCHANTABILITY, ANY WARRANTY OF FITNESS FOR ANY PARTICULAR PURPOSE, ANY WARRANTY THAT THE COAXIAL CABLE SHALL BE DELIVERED FREE OF THE RIGHTFUL CLAIM OF ANY THIRD PERSON BY WAY OF INFRINGEMENT OR THE LIKE, OR ANY OTHER WARRANTY OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY. COMMSCOPE NEITHER ASSUMES NOR AUTHORIZES ANY PERSON OR ENTITY TO ASSUME FOR IT ANY OTHER LIABILITY OR OBLIGATION IN CONNECTION WITH THE SALE OR USE OF THE COAXIAL CABLE, AND THERE ARE NO ORAL AGREEMENTS OR WARRANTIES COLLATERAL TO OR AFFECTING THE SALE OF THE COAXIAL CABLE. THE WARRANTIES, OBLIGATIONS, LIABILITIES AND REMEDIES SET FORTH HEREIN ARE LIMITED TO THEIR PRECISE TERMS COMMSCOPE SHALL NOT BE LIABLE FOR ANYDAMAGE OF ANY KIND, INCLUDING, WITHOUT LIMITATION, SPECIAL, INCIDENTAL OR CONSEQUENTIAL
DAMAGES RESULTING FROM OR IN CONNECTION WITH ANY BREACH OR WARRANTY OR OTHERWISE. THE OBLIGATIONS
AND LIABILITIES OF COMMSCOPE AND THE REMEDIES OF BUYER SET FORTH HEREIN SHALL BE COMMSCOPE’S SOLE AND
EXCLUSIVE OBLIGATIONS AND LIABILITIES AND BUYER’S SOLE AND EXCLUSIVE REMEDIES FOR, RESULTING FROM OR IN CONNECTION WITH THESE WARRANTIES OR ANY BREACH THEREOF.
The terms and conditions contained herein and the rights of the parties to any transaction to which they relate shall be governed by the construed in accordance with the laws of the State of North Carolina of theUnited States of America.
