Supplier Diversity
SBA Criteria
CommScope uses the Small Business Administration (SBA) criteria for designating a supplier as a small, minority- or woman-owned, or disadvantaged business. Detailed explanations of these criteria can be found in the United States Code (15 U.S.C. § 632) and in the Code of Federal Regulations (13 C.F.R. Parts 121, 124 and 126). Summaries of the various criteria are set out below.

MINORITY BUSINESS CONCERN:
Businesses owned and controlled by individuals from groups that have historically been subjected to racial or ethnic prejudice or cultural bias because of their identities as members of groups without regard to their individual qualities. The social disadvantage must stem from circumstances beyond their control.

In the absence of evidence to the contrary, the following individuals are presumed to be socially disadvantaged: Black Americans; Hispanic Americans; Native Americans; Asian Pacific Americans and Subcontinent Asian Americans. From time to time, this list may be amended by the SBA.


SMALL BUSINESS CONCERN:
A business concern organized for profit that meets the SBA size standards for small businesses, with a place of business located in the United States, which operates primarily within the United States or which makes a significant contribution to the U.S. economy through payment of taxes or use of American products, materials or labor. See www.sba.gov/size for the current size standards for your industry.


SMALL DISADVANTAGED BUSINESS ENTERPRISE (SDB):
A small business concern that is at least 51% owned by one or more socially and/or economically disadvantaged individuals or, in the case of any publicly owned business, at least 51% of the stock of which is owned by one or more such individuals, and whose management and daily business operation are controlled by one or more such individuals. The Disadvantaged Small Business must have certification from the SBA. Socially and economically disadvantaged individuals include:
  African Americans (U.S. citizens)
  Asian Americans
  Subcontinent Asian (Asian-Indian) Americans
  Asian-Pacific Americans
  Hispanic Americans
  Native Americans
  Other individuals, other than one of the preceding, currently certified for participation in the Minority Small Business and Capital Ownership Development Program under Section 8(a) of the Small Business Act.


VETERAN OWNED SMALL BUSINESS:
A small business that is at least 51% owned, operated and controlled by a qualified veteran or veterans who has been honorably discharged by the US Government or, in the case of any publicly owned business, at least 51% of the stock of which is owned by one or more such individuals, and whose management and daily business operation are controlled by one or more such individuals.


WOMAN OWNED SMALL BUSINESS CONCERN:
A small business that is at least 51% owned by a woman or women who also control(s) and operate(s) it. "Control" in this context means exercising the power to make policy decisions. "Operate" in this context means active involvement in the day-to-day management.


HUBZone Small Business
A business that meets the following criteria:
Must be located in a "historically underutilized business zone."
Must be owned and controlled by one or more U.S. Citizens, and at least 35% of its employees must reside in a HUBZone.
HUBZone Small Businesses must have certification from the Small Business administration.

CommScope is committed to continuous improvement in diversity spending by looking to increase diversity content with current and potential new suppliers. In 2005, CommScope expects to spend
7-8% of corporate spending with
diversity suppliers.
